SINGAPORE: He knew that members of the public had made complaints against his salesmen, who were going door to door selling fire extinguishers, over their deceptive sales practices.

And when the police began looking into his employees' conduct, the sole proprietor of Fire Safety & Prevention (SG) instructed them in a group chat to give identical likely false accounts to investigation officers as he did not want business to be affected.

Kelvin Tan Yaosheng, a 43-year-old Singaporean, was jailed for a week on Thursday (Aug 29) for one count of obstructing justice. A second similar charge was taken into consideration.

The court heard that Tan's employees had practised deceptive sales tactics when selling the extinguishers.

When the men went door to door, they would use one or more of these tactics.

These included telling residents that they were engaged by a public body or community centres in Singapore, that the residents would get a discount if they had PAssion cards as the salesmen were working with the People's Association, and that the fire extinguishers were priced at S$17.90 (US$13.80).

In truth, these were lies. The extinguishers actually cost S$179 each, and none of the salesmen were working with any public body.

Tan received multiple complaints from members of the public about the tactics his salesmen were using.

In May 2019, a customer complained that an employee had sold them a fire extinguisher said to cost S$17.90, but the customer was later charged S$179.

Another customer made the same complaint a month later.

In November 2019, Tan was made aware that another person had made a police report with the same complaint.

The police received several reports over the deception by Tan's employees in pushing sales of the extinguishers.

They called Tan and his employees in separately to assist with investigations. Tan was one of the first to be called and went for an interview with the police on Mar 4, 2020.

Shortly after giving his statement that day, Tan sent a message to a WhatsApp group chat he had with his employees.

He told them that investigation officers may call them down for investigations, and instructed them on what to say if the police interviewed them.

They were to state that they sold each fire extinguisher for S$179, that this was the price that they had always given to customers, that they never quoted a price of S$17.90, and that they always got customers to sign on invoices first to let them know the price was S$179 before collecting payment.

Tan knew that there were many complaints against his employees, and that the account he instructed his employees to give to the police was likely false.

Tan also ensured that all his employees acknowledged his messages with instructions to them. The employees understood that Tan was asking them to align their statements with his.

One of the employees, Chai Ri Jou, later admitted to the police that he had gone along with Tan's account instead of the truth as Tan was his boss.

Chai was jailed for two weeks for cheating.

In June 2020, officers from the Competition and Consumer Commission of Singapore (CCCS) called Tan in to assist with their investigations over the same issue.

Tan found out that CCCS was also calling up his employees, so he asked them to delay their interviews until after he had done his so that he could tell them what CCCS would ask.

Tan similarly instructed them to give the same account to CCCS. This constitutes the charge taken into consideration for his case.

CCCS published an advisory in 2020 alerting consumers to the unfair practices of fire extinguisher suppliers, including Fire Safety & Prevention (SG).

SENTENCING ARGUMENTS

Deputy Public Prosecutor Louis Ngia sought one to two weeks' jail for Tan, saying he had crafted a narrative for his employees and instructed them to "uniformly lie to the police".

While the amount involved is low, the employees' cheating offences involved deceiving victims into believing they were engaged by a public body or working with the People's Association.

This impugned the public's confidence in public administration in Singapore, said Mr Ngia.

Tan was represented by Mr Navin Naidu and Mr Manfred Lum from Dentons Rodyk & Davidson, who sought a fine instead.

In sentencing, District Judge Kok Shu-En said she accepted the defence's point that Tan was not a typical offender who was trying to cover up his own misconduct.

She also accepted that he did not have full or direct knowledge of the deceptive sales practices.

However, Judge Kok said it seemed to her that Tan "was not particularly concerned" about what the truth was, even though he had received complaints from customers.

His greater concern was that the police should receive a version of events that would benefit him, said the judge.

She said Tan had not only instructed one employee but the entire group, making this an attempt to interfere with investigations "at scale".

She said there was "nothing altruistic" about his conduct, and that he was motivated entirely by his own concerns.

For obstructing justice, he could have been jailed for up to seven years, fined, or both.

6 firefighters among injured in Ocean Hill fire, 31 left homeless

OCEAN HILL, Brooklyn (WABC) -- Nine people are hurt after a fire broke out at a row of homes in Brooklyn.

Six of the injured include firefighters tasked with putting out the flames.

It happened at 2411 Dean St. in the Ocean Hill section just after 10:30 p.m. Monday.

Most of the injured are firefighters and more than 30 people are now without a place to live.

The damage left behind from this fire is eye-opening as this multi-alarm fire burned the homes and left them in shambles with blown-out windows.

The FDNY says the roof of the first building to catch fire collapsed into the top floor as firefighters battled to keep the flames from spreading. One neighbor says the fire was stubborn and up put up a fight.

"It was like an inferno, everything was fire, fire. It was flames coming out, then the fire kept moving from one house to the next, to the next. It went through four houses. So the firefighters started fighting the fire in this house but then the other house keep going, so they went back and forth, back and forth," Federico Pagan told Eyewitness News.

The FDNY says the fire spread through the cocklofts to four of the other homes on Dean Street.

Another woman who lost everything in the fire said she'd only stepped out for a few minutes before she came back home to chaos.

"I was worried because it's an older guy who was in the second floor. Like, we're happy he was able to get out as well. And yeah, it was a lot of actually like three or four elderly people and they were all able to get out. So but it's just crazy like how everybody lives is just like disturbed now at this point," Hope Hatcher, fire victim, told Eyewitness News.

One person reportedly jumped out of the building to escape the flames, according to witnesses.

Overhead drone images captured by the FDNY shows crews working for hours to get things under control. They completely doused the flames after three hours.

An investigation into the cause of the fire is ongoing.

People who live in the building where the fire started say nothing inside is salvageable.

Officials say the roofs of all five buildings partially collapsed, and the Department of Buildings has issued a full vacate order.

The property owners will have to install a fence around the buildings.

Meanwhile, Red Cross NY's disaster team responded to the fire and provided 10 families with emergency housing and financial assistance.

Every one is responsible to prevent fire through taking precautions to equip our homes, businesses and gathering places to protect them from fire. Efforts should be renewed in order to be prepared in a better way in case there is event of fire. Education on fire safety is very important through local companies that deal with fire prevention to help young people learn how to accept fire safety as their way of life. Firefighter should respond to alarms, safeguard lives and protect property in the community and volunteers should help to raise money to pay for equipments that are used to prevent fire. (Artim, 2002 pp16-18).

There are station tours where a minimum of thirty people book a tour to fire stations where they get an inside look at apparatus that are used to prevent fire and tools used for other emergencies. They get a demonstration of how to use gear of a firefighter and are taught on the general information on fire safety where they take one hour to complete the tour. Station tours are scheduled during morning hours from Monday to Saturday in order to accommodate daily schedule of fire fighters. (Warda, 1999 pp11-13).

Hazard house is a tool used to teach and captivate children and adults on ways of preventing and reducing hazards at home and action to be taken incase of emergency. There is smoke that is simulated from fire, sound of smoke detectors, visual graphics and electrical arching that capture attention of children and adults to the house in one hour presentation. There are safety demonstrations in major rooms in a house on the importance of being safe from hazards. (Leonard, 1998 pp 34-37).

Explanation of why it is necessary to condemn unsafe structures

Public works has responsibility of safety of buildings and compliance with codes. A building may be condemned for demolition by building development because of violating code and safety requirements. The enforcement group for property code in public works may have some property violations in case they violate sanitary, health and maintenance. Orders may be issued by inspectors of building and development for the building of structures to be stopped if it fails to meet building and safety codes. The inspectors give report of damage of building due to fire, tree falls and natural events that cause compromise of building integrity. (Nick, 2001 pp 32-35).

Any structure that needs to be repaired due to old age or its condition is dilapidated can be liable to fire and if it is situated in a position where it can endanger other buildings or property or in case of fire it can endanger other property, it is necessary for it to be condemned and declared unsafe for use and therefore need to be demolished. Any structures with temporary plumbing violate provisions for installation, repair and maintenance and plumbing code. It is considered to be dangerous to safety of building and the people who use the premises. (Sleet, 2003 pp 27-30).

Structures that are faulty or defective violate provisions for construction and building code. These buildings are not safe for use and should be repaired or rebuild again before they are used. The building should not have electrical installation that is temporary and should obey electrical code which is enacted from time to time and violation of it endanger the safety of buildings. (Ben, 2005, pp 11-14)

Evaluating why environmental concerns must be considered when fire safety codes are delivered

Each region has codified rules which are organized concerning structures, materials and methods used in construction. The codes are based on experiences locally and conditions. To ensure safety of fire, the only materials to be allowed should be the ones that pass tests which are set if materials produced are used locally. As industries continue to develop, goods produced are distributed beyond borders of home countries. In construction industries, building materials are consumed at place of origin and also distributed in other regions. (Ethan, 2004 pp 07-09).

The methods for testing put limits on structures and materials to be used and are able to evaluate safety performance required for fire and develop and make use of new materials. Design methods for fire safety that are engineering oriented enable fire prevention to be more rational making it possible to design building in flexible manner with a lot of freedom. (Renny, 2003. pp 22-23).

There is need to have testing methods for fire safety in materials used for building and construction. Whether the material is recognized be fireproof that is competitive in the market, company design products that pass testing for fire safety. In case of differences in evaluations of materials given by different countries, it was impossible to distribute it to international markets. As building structures become varied and advance in design, issues about structures, materials and equipments are raised. (Pippen, 1999, pp 12-14).
